How do I Obtain a Personal Protection Order?

PPO PROCEDURE

Oakland County Circuit Court                  1200 N. Telegraph                  Pontiac, MI 48341

Go to the Probate Court/Juvenile Intake Department in the east wing on the ground floor of the courthouse.

Ask the clerk at the PPO Window for a PPO packet.  He or she will ask you a few questions and decide whether you want the domestic packet or the stalking packet.

Go to the PPO Office, across the lobby from the PPO window.  If you need help filling out your forms, the PPO advocate will help you.  Even if you do not need help, it is still a good work area with tables and chairs.

Complete all the forms in the PPO packet.

Take your completed forms to the County Clerk’s Office.  It is on the ground floor of the courthouse in the center hallway.  Give your forms to a staff member at the counter.

She or he will file (start) your case, assign a judge, and give you a case number and case labels.

Go back to the Probate Court/Juvenile Intake Office.

Give your PPO packet to the staff member at the PPO window.  He or she will tell a court referee (a lawyer who helps the judges by reviewing your request for a PPO) that you are asking for a PPO.

The referee will look at your forms, and may call you into an office to ask you about your request.

The referee will complete a recommendation for the judge.  He or she will put it in a sealed envelope. \

A staff person will give you back your forms and the sealed envelope.  He or she will tell you how to get to the judge’s chambers (office).

Take the sealed envelope and all your forms to the judge’s chambers (office).

Give your forms and the sealed envelope to the judge’s clerk.

While you wait, the judge will review your forms, and the referee’s recommendation, and grant or deny your request for an ex parte PPO.

If the judge grants your request, and signs the PPO order, you must go back to the County Clerk’s Office on the ground floor and give all your forms to a staff member at the counter.

If the judge denies your request and your are entitled to a hearing, the judge’s clerk will schedule one for you.  You must go back to the County Clerk’s Office on the ground floor and give your forms to a staff member at the counter.  The County Clerk’s staff member will explain how to tell the other person about the hearing.

The County Clerk’s staff member will give you several copies of the order or other forms that you need.

You must give (serve) a copy of the signed order to the other person.  The County Clerk’s staff will explain how to do this.
